1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you (whether individually or on behalf of an entity) and WorkWitness Technologies (referred to as "we", "us", or "our"), concerning your access to and use of the WorkWitness software, agent, website, and related services (collectively, the "Service").

By deploying the WorkWitness Windows agent or accessing any part of the Service, you represent that you have the authority to bind your organization to these terms, and that you accept them in full. If you do not agree to these terms, you are strictly prohibited from using the Service.

2. Description of Service

WorkWitness provides a privacy-first AI productivity assistant. It operates via a lightweight desktop agent for Windows operating systems that records teammate active windows, active browser domains, focus spans, and idle/active times.

Our proprietary AI processing engine analyzes this daily activity and summarizes the workload data into a single, cohesive narrative paragraph (the "Daily Brief") delivered via email and WhatsApp. Detailed dashboard tracking and optional screenshot captures are available under the workspace owner's admin controls.

3. Mandatory Disclosure Rule

In many jurisdictions, failing to inform employees that their activity, app names, or screenshots are being logged is illegal. We strongly recommend, and require as a condition of using our Service, that you disclose the use of the WorkWitness agent to all monitored teammates in a clear and written format, detailing exactly what is being monitored.

4. Data Capture & Privacy Bounds

Our Windows agent is engineered with a strict boundary system. We are committed to transparency regarding what is captured and processed:

DPDP Act Compliance: In accordance with India's Digital Personal Data Protection Act (2023), WorkWitness provides built-in events-only masking and local data scrubbing to ensure sensitive employee text or query parameters are stripped locally prior to any transfer to our AI model processors.

5. Subscription & Payment

Pricing Tiers: WorkWitness is completely free to use for small teams of three (3) or fewer teammates, without any per-feature limitations. For teams exceeding three users, subscriptions are priced at ₹65 (approx. $1) per user per month above the free limit.

Billing & Cancelation: Subscriptions are billed on a recurring monthly cycle. You may cancel your team's subscription at any time from your admin portal dashboard. Upon cancelation, your card will not be charged for the subsequent cycle, and access to features will remain active until the end of the current paid period. We do not provide refunds or credits for partial months.

6. Limitation of Liability

To the maximum extent permitted by applicable law, WorkWitness Technologies, its directors, employees, or agents shall not be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service.

We make no guarantees regarding the uninterrupted availability of the Service, the absolute accuracy of the AI-generated Daily Briefs, or the prevention of deliberate "gaming" of the activity tracking agent by monitored teammates. The Service is provided on an "as-is" and "as-available" basis.

7. Governing Law & Dispute Resolution

These Terms of Service and your use of the Service are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any legal action or dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
